MARITAN, Grisel Galiano; MORALES, Noadys Milán y ENDARA, Oscar Alberto Ayala. Theoretical systematics on constitutional justice: a necessary path for a renewed guarantor in Ecuador. RCUISRAEL [online]. 2024, vol.11, n.3, pp.177-199. ISSN 2631-2786. https://doi.org/10.35290/rcui.v11n3.2024.1120.
This paper focuses its study on the theoretical and conceptual dimensions of constitutional justice as a macro guarantee, identifying each of its elements, and how they require, in the case of Ecuador, a proper confluence in defense of constitutional supremacy, in order to showcase the strengths of a true Rule of Law that upholds respect for and protection of fundamental rights and individual freedoms. The research objective is to characterize the theoretical elements that underpin constitutional justice as a macro guarantee from a doctrinal and normative perspective. The methodology employed is of a theoretical nature, with a qualitative approach that allowed for the use of methods and techniques typical of legal social research, including historical-logical analysis, exegetical-analytical method, comparative method, and, of course, bibliographic analysis. The most relevant results help illustrate some of the deficiencies that hinder the effective performance of Constitutional Justice, especially with regard to the mechanism of constitutional control provided by the Ecuadorian Supreme Law, leading to the conclusion of the evident constitutional legal dissonance that exists in these cases
