The purpose of this essay is to assess the importance of the legal institutions of confusion and renewal in trademark law, particularly with respect to the Ecuadorian country trademark. The study addresses the definition, advantages and importance of the legal recognition of the country trademark, within the Ecuadorian industrial property law, based on international instruments that protect trademarks worldwide. The national regulations are addressed, ranging from the Constitution to the Organic Code of the Social Economy of Knowledge, Creativity and Innovation of 2016. By establishing the bases of study in the national and international legislation, the question of whether the country trademark generates confusion in the national trademark law is made, based on the various controversies that it has generated. It concludes by answering another question: Is the renewal of the Ecuador country trademark necessary?
