Ecuador is a transit country for drug trafficking, however, the legal device with which the State faces such behaviors presents imbalances and instability. From 2014 to date, two judicial precedents and a legislative reform have been issued without achieving the maximum performance of the norm. The objective of the article is to propose a theory of the type that provides the norm with rational validity, that guides or disciplines the conduct towards the object of legal protection, not towards the control of substances that are administratively competent, if people do not understand the prohibition of Kind less could be expected of its effectiveness. A documentary review was carried out on conceptual elements of bankruptcy theory, specifically, ideal and real competition and simple unit of action. Comparative legislation shows the behavior of the norm in Latin American countries with respect to Ecuadorian criminal law. The investigation concludes on the need to reform the type of illicit trafficking in Ecuador, replace the criminal scales that obstruct the filter of typicity and its definitive transfer to the drug law, which humanizes the type and guarantees its correct operation.
