Abstract

The communities of Alto Naya in Colombia managed to title their ancestral territories in the year 2016, but failed to materialize. Inefficient and largely ineffective territorial development policies affect their rights by claimants of territorial property based on legalities dating from the Spanish Colony and economic agents who see in these lands the possibility of exploiting on a large scale the abundant natural resources, converting indigenous and afrocolombian people to wage-earning workers. In this direction, the transfer of functions of institutions responsible for executing judgments of judicial and control bodies, regarding the titling of ancestral lands and lack of clarity about functions, makes policies aimed at giving solution, become increasingly conflicting.
