This research article focuses its efforts on understanding the adverse effect of corruption within state procurement. This situation is becoming a nuisance for civil society because it has a negative impact on the progress of the nation. Legal and documentary hermeneutics is used as a tool to interpret with a critical basis the norms that regulate the conduct of free competition and the defense of collective rights promulgated in the Political Constitution of 1991, when reviewing the foundations of Law 80 of 1993 and the other regulations that delimit state contraction, sanctions for corruption and the SECOP disclosure system necessary to monitor it. Concluding in the need to maintain an assertive criterion among public officials when selecting a contractor, since the State has great difficulties monitoring each contract's progress in the country.
