The continuous development of wireless communication applications, reflected on the growing number of users and the variety of wireless devices for everyday applications, represents a growing demand for radioelectric spectrum. At busy hours some bands are overloaded while others remain unused. Therefore, the efficiency with which the access to this finite resource is administered is of great importance for the future and the idea of developing tools for better use of the radio spectrum is related to a complex and growing demand for use. Technological advances are enabling the development of communication systems with the potential of using radio resources in a more dynamic and efficient way. In this context, Cognitive Radio (CR) techniques offer improved efficiency and additional flexibility regarding the use of the spectrum. In Latin America, spectrum occupation does not appear today as an immediate problem and although there are some local experiences that have applied CR technology, in many cases there are still no control mechanisms and resource management for this use, for example, in Uruguay. There is a need to find the management mechanism that adapts to opportunistic access in the best way because it will allow, among other benefits, the growth of these systems and a better use of the resource. To make it possible, it is necessary in each country to develop the necessary regulatory framework. This paper presents the basics about CR, its benefits and challenges, information about existing standards as well as implementation examples of these systems, that suggest that legal and regulation frameworks can enable or hinder the develop of CR issues.
