In 2008, the professor Gerald Neuman published an article that generated debate not only on the relevance of the Inter-American System of Human Righst (IASHR), but also its legitimacy in the región. After almost 10 years after publishing this article, this work will review one of the pillars that allowed Professor Neuman to build his arguments and which many others have mentioned: the very low compliance with decisions made by the Court and their relationship with the notion of “efficiency” or “legitimacy” of the regional Tribunal and with its mechanism of interpreting the Convention. The work concludes with the necessity of exploring regional consensus of the scope and concept of the rights involved in decisions as a mechanism of interpretation of the treaty.
