The right of man to decent housing appears among the fundamental rights of citizens. The conventions, international treaties on human rights and the various social circumstances that have been pragmatized in the jurisprudence of the courts and Constitutional Courts. The emergence of social constitutionalism and the implementation of the Constitutional state of rights and Justice in Ecuador, have had various results despite the identical normative expression and the primary objective that seeks in the content of the right to decent housing and creating a framework of differential response to the different actors that claim this right; considering the degree of vulnerability of the claimant populations due to the lack of application and failure to comply with factors that make the right to housing a fundamental right or, finally, a fiction of law.
