Abstract

This work explores the relationship between private law and unfair competition causes of action, through an analysis of the main characteristics of the doctrine of unjustified enrichment through unfair competition in Spanish law. This analysis suggests that special unfair competition actions protects economic interests that may justify a departure from common private law. This conclusion may have important implications in the assessment of the requirements of unfair competition causes of action, particularly in legal systems where such causes of action are primarily recognized to vindicate the private interests of market actors.
