Con el surgimiento del postpositivismo emergieron constituciones garantistas, como la Constitución de la República de Ecuador del 2008 (en adelante CRE), en la cual se estableció la creación de la Corte Constitucional (en adelante CC) como máximo órgano de control, interpretación y de administración de la justicia constitucional. Esta investigación tiene como objetivo analizar el posicionamiento de la CC y la influencia que ejerce frente a las actuaciones dispuestas por los diferentes órganos de las funciones del Estado. Para esto, se analiza si la CC ha reconocido derechos a colectivos y minorías, y ha ejercido control sobre la producción legislativa. La pregunta principal que esta obra busca resolver es si la CC, por sí misma, se encuentra al mismo nivel de las cinco funciones del Estado.

With the emergence of Postpositivism, guarantees constitutions emerged, such as the Constitution of the Republic of Ecuador of 2008 (hereinafter CRE), in which the creation of the Constitutional Court (hereinafter CC) was established as the highest body of control, interpretation and administration of constitutional justice. This research aims to analyze the position of the CC and the influence it exerts against the actions issued by the different organs of the State functions. For which it is analyzed if the CC has recognized rights to groups and minorities and has exercised control over legislative production. The main question that this work seeks to resolve is whether the CC, by itself, is at the same level as the five functions of the State.
