La soberanía alimentaria se ha abordado desde lo normativo y la jurisprudencia; no obstante, es necesario comprender su alcance constitucional en el contexto de la región latinoamericana; todo ello, en función del nuevo paradigma que supone la conjunción de lo agrario, lo alimentario y lo ambiental, dentro de la concepción de acceso oportuno y equitativo de alimentos inocuos. Esto conllevó al análisis de la naturaleza jurídica de la soberanía alimentaria reconocida en algunos ordenamientos como principio o también como derecho fundamental, sobre la base del derecho internacional público y el derecho constitucional latinoamericano nutrido del buen vivir, contrastado con el modelo de desarrollo sustentable. Desde una investigación documental cualitativa se pudo concluir que la soberanía alimentaria es definida transversalmente; sin embargo, los mecanismos para su observancia no tienen eficacia estatal en lo que respecta a sus elementos necesarios como oportunidad e innocuidad. En América Latina se incorporan elementos de los derechos de los pueblos desde el Sumak Kawsay.

Food sovereignty has been addressed from the normative and jurisprudence; However, it is necessary to understand its scope from the internal constitutional in the Latin American region; all this, based on the new paradigm that supposes the conjunction of the agrarian, the food and the environmental within the concept of timely and equitable access to safe food. This led to the analysis of its legal nature as a principle or as a fundamental right from public international law and Latin American Constitutional Law nurtured by sumak kawsay, contrasted with the sustainable development model. From a qualitative documentary research, it was possible to conclude that food sovereignty is defined transversally; however, the mechanisms for its observance do not have State effectiveness in regard to its necessary elements such as opportunity and safety.
