Pero al no existir un mecanismo específico de aplicación para esta nueva herramienta, se remitió a la regla general de aumento o reducción de las penas por tercios. En este contexto, la investigación aborda la relación que existe entre las penas modulables e inmodulables de las personas jurídicas y los principios de proporcionalidad y determinación de la pena. De esta manera, se encontró que la mayoría de las penas previstas para las personas jurídicas son de carácter inmodulable, lo cual impide su aumento o reducción conforme la regla general, violentando directamente la proporcionalidad.<hr/>Abstract With the reformation of the Código Orgánico Integral Penal in the year 2021, an exclusive system of modifying circumstances of the crime namely, mitigating and aggravating circumstances within the criminal liability of legal persons was implemented. Not foreseeing an exclusive mechanism of application for this new tool, it was remitted into the general rule of increase or reduction of sentences by thirds. Within this context, the investigation addresses the relationship that exists between the modular and the non-modular sentences of the juridical person and the principles of proportionality and determination of said sentence. Finding that most foreseen sentences for juridical persons are of non-modular structure, which prevents its increase or reduction, directly violating the mentioned principles.
